{"id":9,"date":"2023-01-17T11:09:03","date_gmt":"2023-01-17T08:09:03","guid":{"rendered":"https:\/\/piguperku.lt\/?page_id=9"},"modified":"2026-01-05T14:50:32","modified_gmt":"2026-01-05T12:50:32","slug":"rules-5","status":"publish","type":"page","link":"https:\/\/piguperku.lt\/en\/taisykles\/","title":{"rendered":"Rules"},"content":{"rendered":"<div class=\"wp-block-greenshift-blocks-row gspb_row gspb_row-id-gsbp-39ba03d\" id=\"gspb_row-id-gsbp-39ba03d\"><div class=\"gspb_row__content\"> \n<div class=\"wp-block-greenshift-blocks-row-column gspb_row__col--12 gspb_col-id-gsbp-e48506e\" id=\"gspb_col-id-gsbp-e48506e\">\n\n\n<br \/>\n<strong>TERMS AND CONDITIONS FOR PROVIDING SERVICES AND INTERMEDIARY PURCHASING OF GOODS ON THE PIGUPERKU.LT PLATFORM<\/strong><\/p>\n<p><strong>1. Definitions and Contract Interpretation<\/strong><\/p>\n<p>1.1 This service provision agreement (hereinafter \u2013 the Agreement) is executed by UAB Schindler projektai acting as the &#8220;Seller&#8221; on behalf of its client acting as the &#8220;Buyer&#8221;. This Agreement becomes binding on the Data Processor and Data Controller under the General Data Protection Regulation. UAB Schindler projektai services are provided in accordance with the conditions specified below. Every service user, by registering on the PIGUPERKU.LT website, agrees to the service conditions and rules.<\/p>\n<p>1.2 When ordering services online, the contract is considered concluded and effective from the moment the buyer registers and checks the box indicating agreement with these service provision rules and undertakes to comply with them. Data provided during ordering is stored in the Seller&#8217;s database.<\/p>\n<p>1.3 By confirming identity, the Buyer agrees from that moment that UAB Schindler projektai will process personal data according to European Parliament and Council Regulation (EU) 2016\/679. UAB Schindler projektai acts as a data processor on behalf of its client acting as data controller. When processing your personal data, we comply with the European Parliament and Council Regulation (EU) 2016\/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95\/46\/EC (hereinafter \u2013 &#8220;Regulation&#8221;), the Republic of Lithuania Law on Legal Protection of Personal Data (hereinafter \u2013 &#8220;ADTA\u012e&#8221;), the Republic of Lithuania Electronic Communications Law (hereinafter \u2013 &#8220;ER\u012e&#8221;) and other directly applicable legal acts regulating personal data protection, as well as instructions from data protection supervisory authorities (in Lithuania \u2013 the State Data Protection Inspectorate).<\/p>\n<p><strong>2. Buyer&#8217;s Rights and Obligations<\/strong><\/p>\n<p>2.1 During registration, the Buyer must provide correct identifying information to the Seller.<\/p>\n<p>2.2 By checking &#8220;I agree with the website rules&#8221; in the order box and pressing the &#8220;register&#8221; button, the Buyer confirms that they have familiarized themselves with these Rules, agree with them, and undertake to comply with them, i.e., a purchase-sale agreement is concluded between the Seller and the Buyer.<\/p>\n<p>2.3 The Buyer agrees that UAB Schindler projektai does not assume transportation risk for fragile, perishable, and temperature-sensitive items.<\/p>\n<p>2.4 By agreeing to the rules, the Buyer agrees that uncollected and unidentified shipments will be disposed of after a 3-month storage period.<\/p>\n<p>2.5 By agreeing to the rules, the Buyer agrees to collect shipments within 30 calendar days of arrival at the PirkEU collection point. If the shipment is not collected within 30 calendar days from the day the shipment arrived in Lithuania, a fee of 1 EUR per additional storage day applies. This fee is calculated separately for each buyer&#8217;s shipment.<\/p>\n<p>2.6 By registering, the Buyer agrees to receive informational emails about shipment status changes, important information about changes, and other news. Information is sent until you provide notice of refusal to receive direct marketing messages.<\/p>\n<p><strong>3. Seller&#8217;s Rights and Obligations<\/strong><\/p>\n<p>3.1 The Seller undertakes to deliver goods received in warehouses in Germany, Spain, Poland, England, France, Italy, Latvia, Netherlands, and Czech Republic to Lithuania for the buyer, provided the buyer has not violated their obligations.<\/p>\n<p>3.2 The Seller undertakes to ensure the confidentiality of the Buyer&#8217;s information entrusted to them and not to transfer it to third parties without the Buyer&#8217;s consent, except in cases provided by law.<\/p>\n<p>3.3 The Seller is not responsible for unreceived or damaged shipments.<\/p>\n<p>3.4 UAB Schindler projektai is not responsible for non-delivery of postal shipments if an incorrect address is provided or the recipient refuses to accept the postal shipment.<\/p>\n<p>3.5 The Seller undertakes to prepare an order for collection\/dispatch only when all shipments contained therein have been received at the shipment distribution center.<\/p>\n<p>3.6 When choosing delivery through our partner services (Omniva\/SmartPosti), during shipment delivery, the Buyer or Buyer&#8217;s representative, together with the transport company representative, must check the shipment condition during delivery. If goods are accepted from the courier without complaints, complaints about damaged goods will not be considered.<\/p>\n<p>If damage to the shipment packaging is detected, the Buyer or Buyer&#8217;s representative must refuse to accept the shipment. In such cases, the transport company representative, together with the Buyer or Buyer&#8217;s representative, fills out a special shipment inspection report indicating the damage found. Submit complaints about damage or other non-compliance within 24 hours of receiving the shipment (from when you confirm receipt of the shipment by signing to the courier).<\/p>\n<p>If the Buyer or Buyer&#8217;s representative accepts the shipment and signs the transport company representative&#8217;s electronic device or paper delivery confirmation without remarks, it is considered that the goods were delivered in undamaged shipment packaging, and additional services indicated in the electronic device or paper delivery confirmation were properly performed, unless proven otherwise.<\/p>\n<p>3.7 If you choose delivery to our partner (Omniva\/SmartPosti) parcel machines, you must check the shipment at the parcel machine when collecting it. If you notice that the shipment is damaged, immediately contact PirkEU customer service. Upon contacting our customer service department, you will be provided with all necessary information to file a complaint with the courier service.<\/p>\n<p>3.8 UAB Schindler projektai responsibility begins only from the moment a UAB Schindler projektai employee accepts the shipment at the foreign warehouse. If the shipment was improperly packaged and damaged during transportation due to improper packaging, UAB Schindler projektai is not responsible for compensation to the client, even if the shipment was accepted.<\/p>\n<p><strong>4. Payment Procedure<\/strong><\/p>\n<p>4.1 All payments, depending on your chosen payment method, are made by transfer to the UAB Schindler projektai bank account or the bank account of UAB Schindler projektai authorized third party Paysera LT, UAB, providing payment services, as indicated on the website.<\/p>\n<p><strong>5. Insurance<\/strong><\/p>\n<p>5.1 All our customer shipments are automatically insured with &#8220;ERGO Insurance SE Lithuanian Branch&#8221; according to standard carrier liability (According to the Convention on the Contract for the International Carriage of Goods by Road (Warsaw Convention)), which is free for the client. However, standard carrier liability, according to the Convention on the Contract for the International Carriage of Goods by Road (Warsaw Convention), compensates approximately 10 euros per 1 kilogram. The client can additionally insure the shipment using the PirkEU platform.<\/p>\n<p>5.1.1 The insurance amount cannot exceed the actual purchase value. For fraudulently indicating or falsifying a higher shipment value than actual, the sender may be held criminally liable.<\/p>\n<p>5.1.2 If a shipment is collected at a collection point, the shipment must be inspected during collection. Otherwise, shipment insurance may not apply.<\/p>\n<p>5.1.3 Insurance is valid for transportation to the distribution center. If delivery through courier or parcel machine is ordered, insurance responsibility is transferred to the third party performing the delivery.<\/p>\n<p><strong>6. PIGUPERKU.LT Goods Purchase Service<\/strong><\/p>\n<p>6.1 UAB Schindler projektai is an intermediary between the goods seller and buyer, therefore UAB Schindler projektai is not a goods seller and is not responsible for successful goods delivery to UAB Schindler projektai warehouses in foreign countries, goods quality, packaging, and other matters unrelated to UAB Schindler projektai services. In case of problems between buyer and seller, UAB Schindler projektai, upon timely notification from the buyer about problems, can only offer communication-type assistance. If necessary, UAB Schindler projektai can send all required payment confirmations.<\/p>\n<p>6.2 Each sold item&#8217;s characteristics are indicated by the foreign online store&#8217;s goods seller in each item&#8217;s description. UAB Schindler projektai is not responsible for foreign online store items possibly not matching actual item size, form, or color in terms of color, form, or other parameters.<\/p>\n<p>6.3 Foreign online store sellers, according to their country&#8217;s legislation, provide certain product categories with quality guarantees for purchased items valid for a certain period, whose specific terms and other conditions are indicated in product descriptions.<\/p>\n<p>6.3.1 More detailed information related to product warranty conditions is provided in foreign online store descriptions.<\/p>\n<p>6.4 UAB Schindler projektai is essentially a disclosed intermediary (VAT Law Article 2, Part 6), therefore can only issue invoices for intermediary services (VAT Law Article 16, Part 1). You can read more about this on the State Tax Inspectorate website.<\/p>\n<p>6.5 UAB Schindler projektai can only issue invoices for the intermediary amount, i.e., the difference between the amount you paid to UAB Schindler projektai and the original goods amount with delivery to UAB Schindler projektai warehouses in foreign countries. UAB Schindler projektai does not issue invoices for goods you purchased since it does not sell them but only intermediates in ordering goods from foreign online stores. Upon client request, UAB Schindler projektai can ask the seller to issue an invoice with client-specified details and provide other purchase documents.<\/p>\n<p>6.6 UAB Schindler projektai is an intermediary between buyer and seller and provides goods purchase services, so we only generate invoices for the purchase service. The invoice for the goods you purchased is generated by the foreign store selling it. Please note that the goods invoice is issued only to natural persons, in the name of the person who placed the order.<\/p>\n<p>6.7 The goods purchase service price depends on the goods value (if the seller&#8217;s delivery to the PirkEU warehouse abroad is paid, it is added to the goods amount).<\/p>\n<p><strong>7. Goods Returns<\/strong><\/p>\n<p>7.1 Goods purchased through PIGUPERKU.LT cannot be returned since UAB Schindler projektai is not an official distributor or manufacturer of products in the online store. However, we perform goods returns to foreign stores through the PirkEU platform. This is a paid service whose costs are covered by the client. Goods are returned through DPD couriers, with rates depending on the country to which items are returned and your shipment size. UAB Schindler projektai is a disclosed intermediary providing goods purchase and delivery services.<\/p>\n<p><strong>8. Money Refund<\/strong><\/p>\n<p>If the Seller cannot fulfill the PIGUPERKU.LT goods purchase service, refund of the Buyer&#8217;s paid money is executed within 7 business days from receiving the request. IF THE ORDER IS ALREADY PAID AND SENT TO LITHUANIA, WE CANNOT CANCEL IT. Paid and shipped orders to Lithuania ARE NOT REFUNDED. Only after receiving the goods and ensuring they are unsuitable or defective can the return procedure be performed. Money is refunded only for the goods. Money is not refunded for the goods purchase and delivery service, except in force majeure cases.<\/p>\n<p><strong>9.
